RESULTS OF THE 2008 ANNUAL TOWN MEETING

 

 

The Town of Cranberry Isles held their annual Town Meeting on March 10th, 2008, at the

Islesford Neighborhood House, Islesford, Maine.  The meeting was called to order at 8:30 a.m. by Town Clerk, Denise McCormick.

 

The following articles were acted upon as follows:

 

1.  To elect by ballot a moderator to preside at said meeting.

    

     Richard Beal nominates Barbara Fernald. 

     6 Votes Cast, 6 Votes for Barbara Fernald.

 

Town Clerk administered the oath to Barbara Fernald.  Before the moderator continued

with the meeting,  Daniel Lief, Selectmen Chair, publicly thanked the Islesford Volunteer Firefighters, who went to Mississippi for Firemen Training.  Barbara Fernald also thanked the many volunteers who give so much of their time and effort for the Town.  In a small town like ours, volunteerism is very important.  Thanks to all who help!

Barbara also thanked the citizens of Cranberry Isles, for taking time out of their busy lives to attend the Annual Town Meeting, reminding us all, that we couldn’t be a Town without all of our input. 

 

2.  To elect by ballot a Town Clerk for the ensuing year and to vote compensation.

 

     Richard Beal nominates Denise McCormick. 

     6 Votes Cast, 6 Votes Denise McCormick

    

     To vote Compensation of $6,500, motion by Cynthia Lief, seconded by Bruce 

     Fernald.

     Unanimous vote to approve.

 

3.  To see if the voters of the Town Of Cranberry Isles will approve use of the Maine

     Municipal Association’s recommended Maine Moderator’s Manual “Rules of Procedures”

     for the conduct of this Town Meeting.

 

     Barbara Stainton motions to approve, seconded by Richard Beal.

     Unanimous vote to approve. 

 

4.  To see if the voters of the Town Of Cranberry Isles will approve opening the floor of this

     Town Meeting to all non-registered citizens for the purpose of discussion only on each of the

     following articles of this 2008 Warrant.

 

     Daniel Lief motions to approve, seconded by Bruce Fernald.

     Unanimous vote to approve.

 

5.  To elect by ballot a Selectman for a term of three years.

 

     Richard Beal nominates Daniel Lief.

     6 Votes Cast, 6 Votes Daniel Lief.

 

6.  To vote compensation for all Selectman for the ensuing year.

     Recommended:  $1700 Chair, $1400 all others.

 

     Malcolm Donald motions to set compensation at $1700 for chairman, $1400 for

     others, seconded by Anna Fernald.

     Unanimous vote to approve.

 

7.  To elect by ballot a Town Treasurer for the ensuing year to vote compensation.

     Recommended:  $8,500.

     Nanette Hadlock nominates Denise McCormick.

     6 Votes Cast, 6 Votes Denise McCormick.

 

     To vote for compensation, Richard Beal made a motion to set compensation at $9,500

     a year, seconded by Barbara Stainton.

     20 Votes Cast, 20 Votes for Compensation to be $9,500.

 

8.  To elect by ballot a Collector of Taxes and Collector of Excise Taxes for the ensuing year

     and to vote compensation.  Recommended:  $24,500

 

     Malcolm Donald nominates Denise McCormick.

     8 Votes Cast, 8 Votes Denise McCormick

 

     To vote for compensation, Daniel Lief motions to set compensation at $24,500, seconded

     by Barbara Stainton.

     Unanimous vote to approve compensation at $24,500.

 

9.  To elect by ballot a member of the Superintending School Committee for a term of three

     years.

 

      Barbara Myers nominates Katherine Chaplin.

      5 Votes cast, 5 Votes for Katherine Chaplin.

 

10.  To vote the hourly rate of pay for Town Officials and employees.

       Recommended: $12 to $20, at the discretion of the Board of Selectmen for the type

       of work performed.

 

       Richard Beal motions to set hourly rate at $12 to $20, seconded by Bruce Fernald.

       Unanimous vote to approve.      

 

11.  To see if the voters of the Town Of Cranberry Isles will vote to collect interest at the rate

       of eleven percent (11%) on all taxes not paid by December 1, 2008. 

 

       Barbara Stainton motions to approve, seconded by Beverly Sanborn.

       Unanimous vote to approve.

 

12.  To see if the voters of the Town of Cranberry isles will vote to allow a two percent (2%)

      discount on all taxes which are paid in full within thirty (30) days of the date shown on the

      original bill as submitted by the Tax Collector.

 

      Ruth Westphal motions to approve, seconded by Daniel Lief.

      Unanimous vote to approve.

 

13.  To see if the voters of the Town of Cranberry Isles will vote to authorize the Treasurer

       to expend funds in January 2009, February 2009, and March 2009 equal in aggregate to

       3/12ths of the Operations Budget approved for the year 2008.   This authorization will

      permit the Treasurer to prepare Financial Warrants for approval by the Board of Selectman,

      prepare checks, and legally pay bills pending approval of the entire Operations Budget

      by the voters in March 2009.

     

      Richard Beal motions to approve, seconded by Malcolm Donald.

      Unanimous vote to approve.

 

Schools:

 

         Revised Articles were handed out by the Superintendent’s Office.  The revised amounts

         were amended on the floor by Katherine Chaplin, School Board Chairman.

 

14A. To see what sum the voters of the Town Of Cranberry Isles will appropriate for the

         total cost of funding public education from kindergarten to grade 12 as described in the

         Essential Programs and Services Funding Act (Recommend $197,923) and to see what

         sum the voters of the Town Of Cranberry Isles will raise as the municipality’s contri-

         bution to the total cost of funding public education from kindergarten to grade 12 as

         described in the essential Programs and Services Funding Act in accordance with the

         Maine Revised Statutes, Title 20-A, §15688 for the period July 1, 2008 to June 30, 2009.

         Hand Count Required.                             School Committee recommends $191,923.

 

        Motion to put Article 14A on the floor was made by Barbara Stainton, seconded by Richard

        Beal.

        Kate Chaplin motions to amend the amount to appropriate from $197,923 to $238,117,

        and the sum to raise from 191,923 to $185,907.  Seconded by Daniel Lief.

        Unanimous vote to amend the amounts.

 

        Hand Count Vote to approve Article 14A:  44 Votes yes, 0 Votes no.

     

     

   

14B. To see what sum the voters of the Town Of Cranberry Isles will raise and appropriate

         in additional local funds for school purposes (Recommend $202,261.) for the period

         July 1, 2008 to June 30, 2009, which exceeds the State’s Essential Programs and Services

         funding model by $195,795.

         Written Ballot Vote Required.                              School Committee recommends $202,261

 

         Motion to put Article 14B on the floor was made by Barbara Stainton, seconded by

         Richard Beal.

         Kate Chaplin motions to amend the amount to appropriate from $202,261 to $164,277,

         and the sum that exceeds funding model from $195,795 to $161,064, seconded by

         Barbara Myers.

         Unanimous vote to amend Article 14B.

 

         Written Ballot Vote to Approve:   34 Votes Yes, 1 Vote No.

 

          Note:  Articles 14A & 14B equal a total appropriation of $350,184.

   

    

14C. To see what sum the voters of the Town Of Cranberry Isles will authorize the School

         Committee to expend for Regular Instruction for the fiscal year beginning July 1, 2008

         and ending June 30, 2009, from the Town Of Cranberry Isles contribution to the total

         cost of funding public education from kindergarten to Grade 12 as described in the

         Essential Programs and Services Funding Act, non-state-funded school construction

         projects, additional local funds for school purposes under the Maine Revised Statutes,

         Title 20-A,§15690, unexpended balances, tuition receipts, state subsidy, and other receipts

         for the support of schools.

         Hand Count Required.                                 School Committee recommends $223,238

14D. To see what sum the voters of the Town of Cranberry Isles will authorize the School

        Committee to expend for Special Education for the fiscal year beginning July 1, 2008

        and ending June 30, 2009, from the Town of Cranberry Isles contribution to the total

        cost of funding public education from kindergarten to grade 12 as described in the

        Essential Programs and Services Funding Act, non-state-funded school construction

        projects, additional local funds for school purposes under the Maine Revised Statutes,

        Title 20-A,§15690, unexpended balances, tuition receipts, state subsidy, and other

        receipts for the support of schools.

        Hand Count Required.                              School Committee recommends $71,426

14E. To see what sum the voters of the Town Of Cranberry Isles will authorize the School

        Committee to expend for Other Instruction for the fiscal year beginning July 1, 2008,

        and ending June 30, 2009, from the Town Of Cranberry Isles contribution to the total

        cost of funding public education from kindergarten to grade 12 as described in the

        Essential Programs and Services Funding Act, non-state-funded school construction

        projects, additional local funds for school purposes under the Maine Revised Statutes,

        Title 20-A, §15690, unexpended balances, tuition receipts, state subsidy, and other

        receipts for the support of schools.

14F. To see what sum the voters of the Town Of Cranberry Isles will authorize the School

        Committee to expend for Student & Staff Support for the fiscal year beginning July

        1, 2008 and ending June 30, 2009, from the Town Of Cranberry Isles contribution to

        the total cost of funding public education from kindergarten to grade 12 as described in

        the Essential Programs and Services Funding Act, non-state-funded school construction

        projects, additional local funds for school purposes under the Maine Revised Statutes,

        Title 20-A, § 15690, unexpended balances, tuition receipts, state subsidy, and other

        receipts for the support of schools.

14G. To see what sum the voters of the Town Of Cranberry Isles will authorize the School

        Committee to expend for System Administration for the fiscal year beginning July 1,

        2008 and ending June 30, 2009, from the Town Of Cranberry Isles contribution to the

        total cost of funding public education from kindergarten to grade 12 as described in the

        Essentials Programs and Services Funding Act, non-state-funded school construction

        projects, additional local funds for school purposes under the Maine Revised Statutes,

        Title 20-A, §15690, unexpended balances, tuition receipts, state subsidy, and other receipts

        for the support of schools.

        Hand Count Required.                              School Committee Recommends $17,916.

14H. To see what sum the voters of the Town Of Cranberry Isles will authorize the School

         Committee to expend for School Administration for the fiscal year beginning July 1,

         total cost of funding public education from kindergarten to grade 12 as described in the

         Essential and Programs and Services Funding Act, non-state-funded school construction

         projects, additional local funds for school purposes under the Maine Revised Statutes,

         Title 20-A, §15690, unexpended balances, tuition receipts, state subsidy, and other receipts

         for the support of schools.

14I.  To see what sum the voters of the Town Of Cranberry Isles will authorize the School

        Committee to expend for Transportation & Buses for the fiscal year beginning July 1,

        2008 and ending June 30, 2009, from the Town Of Cranberry Isles contribution to the total

        cost of funding public education from kindergarten to grade 12 as described in the

        Essential Programs and Services Funding Act, non-state-funded school construction

        projects, additional local funds for school purposes under the Maine Revised Statutes,

        Title 20-A, §15690, unexpended balances, tuition receipts, state subsidy, and other

        receipts for the support of schools.

        Hand Count Required.                                          School Committee Recommends $40,300

14J. To see what sum the voters of the Town Of Cranberry Isles will authorize the School

        Committee to expend for Facilities Maintenance for the fiscal year beginning July 1, 2008

        and ending June 30, 2009, from the Town Of Cranberry Isles contribution to the total

        cost of funding public education from kindergarten to grade 12 as described in the

        Essential Programs and Services Funding Act, non-state-funded school construction

        projects, additional local funds for school purposes under the Maine Revised Statutes,

        Title 20-A, §15690, unexpended balances, tuition receipts, state subsidy, and other receipts

        for the support of schools.

        Hand Count Required.                                          School Committee Recommends $54,781.

 

        Richard Beal motions to approve $54,781, seconded by Rick Alley.

        Note:  Article 14C-14J authorize a total budget of $448,543.      

 

14K. In addition to the amount in Article 14C – 14J shall the Town appropriate and

         authorize the School Committee to expend additional state, federal and other funds

         received during the fiscal year 2008-2009 for school purposes, provided that such

         additional funds do not require the expenditure of local funds not previously appropriated?

         Current Year Totals:  $24,487.                            School Committee Recommends passage.

14L. To see if the voters of the Town Of Cranberry Isles will authorize the School Committee

         to have the Islesford School remain open for the 2008-09 school year with a projected

         enrollment of approximately twelve students.

         Bruce Fernald motions to approve, seconded by Anna Fernald.

         Unanimous vote to approve.

 

14M. To see if the voters of the Town Of Cranberry Isles will authorize the School Committee

          to have the Longfellow School remain open for the 2008-09 school year with an

          Unknown projected enrollment.

                                                                                    School Committee Recommends Passage.

 

          Barbara Myers motions to approve, seconded by Cynthia Lief.

          Unanimous vote to approve.

 

15.   To elect by ballot two members of the Municipal Advisory Commission, which

        consists of seven elected volunteer property owners or registered voters of the

        Town of Cranberry Isles, who shall serve for a period of three years each.

 

        Ballot 1:  Daniel Lief nominates Chris White.

                        6 Votes Cast, 6 Votes for Chris White.

 

        Ballot 2:  Cynthia Lief nominates Lise Pratt.

                        6 Votes Cast, 6 Votes for Lise Pratt.

 

16.  To elect by ballot two members of the Shellfish Conservation Committee, one who shall

       serve for a period of three years and one who shall serve for one.

 

       Ballot 1: (3 Yrs):  Richard Howland nominates Samuel Hyler.

                                     4 Votes Cast, 4 Votes Samuel Hyler.

 

       Ballot 2:  (1 Yr):   Aaron Gray nominates Cory Alley.

                                     6 Votes Cast, 6 Votes Cory Alley.

 

17.  To see what sum the voters of the Town of Cranberry Isles will vote to authorize the

       Board of Selectman to borrow on behalf of the municipality for purchase of a replacement

       timber float measuring 20 ft x 30 ft at the municipal pier facility on Great Cranberry Island.

       Board of Selectman recommends total amount of $15,000.

 

       Barbara Stainton motions to authorize $15,000 to be borrowed, seconded by Malcolm

       Donald.  

       Unanimous vote to approve.

 

 

 

18.  To see what sum the voters of the Town of Cranberry Isles will vote to authorize the Board

       of Selectman to appropriate from the undesignated fund balance for the purpose of capital

       improvements to the municipal pier on Great Cranberry Island.

       Undesignated funds as of January 1st, 2007 is $160,057

 

       Eric Dyer motions to use up to $160,000, seconded by Daniel Lief.

       Unanimous vote to approve.

 

19.  To see if the voters of the Town Of Cranberry Isles will vote to authorize the Board of

       Selectman to contract with the State of Maine, Department of Transportation for a Small

       Harbor Improvement Program (SHIP) Grant of one hundred thirty eight thousand dollars

       (138,600), in which the Town of Cranberry Isles will match the grant by appropriation of

       fifty nine thousand four hundred dollars ($59,400), for the purpose of repairing and  impro-

       ving access to the municipal pier facility on Great Cranberry Island, and using these funds to

       perform said construction.

     

       Barbara Stainton motions to approve grant of $138,600 and appropriation of $59,400,  

       seconded by Ralph Stevens.

       Unanimous vote to approve.

   

20.  To see what sum the voters of the Town Of Cranberry Isles will vote to spend for repair of

      the sea wall at Manset, owned by the Town of Cranberry Isles, and located in the Town Of

      Southwest Harbor, Maine.

      Board of Selectmen recommends a total amount of $15,000.

 

      Richard Beal motions to spend up to $15,000, seconded by Malcolm Donald.

      Unanimous Vote to approve.

 

21.  To see what sum the voters of the Town of Cranberry Isles will vote to spend in support of

       the Island Institute Fellow for 2008.

       Board of Selectmen recommends a total amount of $5,000.

 

       Barbara Stainton motions to approve $5,000, seconded by Malcolm Donald.

       Unanimous Vote to approve.

 

22.  To see if the voters of the Town of Cranberry Isles will appropriate and authorize the

       Treasurer to expend up to two thousand dollars ($2,000) toward the cost of restoring and

       renovating the cemetery on Baker Island.  Said sum to be matched by Islesford Historical

       Society.

       Request made by Hugh Dwelley.                Board of Selectmen recommend approval.

 

       Bruce Fernald motions to approve, seconded by Anna Fernald.

       Majority Vote to approve, 1 vote to oppose.

 

 

 

23.  To see what sum the voters of the Town Of Cranberry Isles will vote to spend for the

       computerization of our assessment records and associated taxation information.

       Board of Selectmen recommends $6,000.

 

       Richard Beal motions to spend up to $6,000, seconded by Barbara Stainton.

       Unanimous Vote to approve.

 

24.  To see if the voters of the Town Of Cranberry Isles will vote to authorize the Selectmen

       to enter into a 5 month lease agreement in 2008 with the Roman Catholic Bishop of

       Portland, Maine for use of the church land on Joy Road in Northeast Harbor, for parking

       of residents of and visitors to, the Cranberry Isles.

       Board of Selectmen recommends $4,000.

 

       Bruce Fernald motions to approve $4,000 for lease agreement, seconded by Richard Beal.

       Unanimous Vote to approve.

 

25.  To see if the voters of the Town Of Cranberry Isles will vote to authorize the Selectmen to

       enter into a revised multi-year contract with Ed Gray Enterprises, Inc. for the operation of

       municipal solid waste collection and disposal services within the Town Of Cranberry Isles.

       This article does not change the previously voter approved contract value.

 

       Barbara Stainton motions to approve, seconded by Daniel Lief.

       Unanimous Vote to approve.

 

26.  To see if the voters of the Town of Cranberry Isles will vote to authorize the Selectmen to

       sign a three (3) year contract for the launching, handling, disconnecting, hauling, storage and

       maintenance of floats and associated ramps owned by and located within the Town Of

       Cranberry Isles, Maine.  Said contract to be put out to bid in the summer of 2008 and have

       a duration extending from the fall of 2008 through the spring of 2011.

 

      Barbara Stainton motions to approve, seconded by Malcolm Donald.

      Unanimous vote to approve.

 

27. To see if the voters of the Town Cranberry Isles will vote to authorize the Selectmen to

      sign a three (3) year contract for the launching, handling, disconnecting, hauling, storage and

      maintenance of floats and associated ramps owned by the Town Of Cranberry Isles, Maine,

      and located in Southwest Harbor, Maine.  Said contract to be put out to bid in the summer of

      2008 and have a duration extending from the fall of 2008 through the spring of 2011.

 

      Richard Beal motions to approve, seconded by Anna Fernald.

      Unanimous Vote to approve.   

 

28.  To see if the voters of the Town Of Cranberry Isles will vote to authorize the Selectmen to

       enter into a multi-year contract for sanding and the removal of snow on the public ways of

       Great Cranberry Island.  Said contract to be put out to bid in the summer of 2008 and have a

       duration of not less than three (3) and not more than five (5) years.

 

       Barbara Stainton motions to approve, seconded by Hugh Dwelley.

       Eve Harrison motions to amend article to read:  Said contract to be put out to bid in the

       summer of 2008 and have a duration of up to five (5) years.  Seconded by Daniel Lief.

       Unanimous vote to amend.

       Unanimous Vote to approve.

 

29.  To see what sum the voters of the Town of Cranberry Isles will vote to authorize the Board

       of Selectmen to borrow on behalf of the municipality for purchase of a snow plowing truck

       and associated equipment, for snow removal and sanding on the public ways of Little

       Cranberry Island.

       Board of Selectmen recommends authorization of $35,000.

 

       Hugh Dwelley motions to authorize borrowing of up to $35,000, seconded by Eric Dyer.

       Unanimous Vote to approve.

 

30.  Shall the Town of Cranberry Isles vote to authorize the Board of Selectmen, on behalf of the

       Town of Cranberry Isles, to join with other participating municipal and quasi-municipal

       employers in a Multiple Employer Welfare Agreement for the provision of employee health

       benefits, as authorized by 24-A MRSA §6601 et seq., said Agreement to be known as the

       “Maine Municipal Employees Health Trust” (Health Trust); and for that purpose and in

       consideration of the mutual covenants and agreements among the participating employers,

       to authorize the Board of Selectmen to enter into a Participation Agreement on behalf of the

       Town of Cranberry Isles and take whatever other actions may be necessary.  The authority

       granted herein shall remain until revoked.

       Note:  Passage of this article does not enter the municipality into the health trust, but is a

       legal requirement for membership if that option is chosen.

       Unanimous Vote to approve.

A delicious lunch of lasagna, beans, salads and homemade breads, with a wide variety of desserts was provided by the Islesford Neighborhood House Association.  Thanks goes out to all the hard

 workers who did the cooking, prep work and the clean-up!!

 

At 12:45 PM, the Moderator called the meeting back to order.

 

 

31.  To see if the voters of the Town Of Cranberry Isles will vote to authorize the establishment

       of a Transportation Committee for a period of one year, the purpose of which is to address,

       on behalf of TCI, issues related to boat transportation between the islands (Great Cranberry,

       Little Cranberry and Sutton) and the mainland (Northeast Harbor and Southwest Harbor).

       Sustaining year-round communities on the islands is only possible if our ferry service is

       operated with a year-round schedule that will accommodate the broad needs and desires of

       community members to easily move back and forth between the islands and the mainland to

       access schools, jobs, health care, shopping and other services.  The committee will be

       expected to prepare a Transportation Plan addressing these needs to be brought to the 2009

       Town Meeting for approval.

      

       The committee will be governed by a board consisting of a)the three Town Selectmen

       b)two voter registered residents of the Cranberry Isles, appointed by the Board of Selectmen

       c)two seasonal residents of the Cranberry Isles, appointed by Board of Selectmen.

 

       Barbara Stainton motions to approve, seconded by Jeri Spurling.

       Barbara Myers motions to amend the committee to be five (5) voter registered residents of

       the Cranberry Isles, appointed by the Board of Selectmen, seconded by Hugh Dwelley.

       Unanimous Vote to amend the article.

 

       Unanimous Vote to Approve.

 

 32.  To see if the voters of the Town of Cranberry Isles will vote their support for the US

       Mayors Climate Protection Agreement, and authorize the Selectmen to sign this

       Agreement on behalf of the municipality. 

      

       Cynthia Lief motions to approve, seconded by Wanda Porter.

       Unanimous Vote to approve.

 

33.  To see what sum the voters of the Town Of Cranberry Isles will vote to authorize the

       Selectmen to spend for the promotion and support of local renewable energy feasibility

       studies, energy conservation efforts and related projects.  Unexpended funds are to be

       carried forward for use in succeeding years and shall not be credited to the general fund.

       Board of Selectmen recommends $10,000.

 

       Bill McGuinness motions to approve $10,000, seconded by Richard Beal.

       Unanimous vote to approve.

 

34.  To see what sum the voters of the Town of Cranberry Isles will vote to authorize the

       Selectmen to spend for the purchase of electrical power from “Maine Interfaith Power and

       Light” or a similar organization, with the intent of using renewable energy as the sole source

       for meeting municipal electrical needs.  Authorization is for one year of expenditure over

       cost of power from Bangor Hydro Electric Co.

       Board of Selectmen recommends $2,000.
